On January 1, 2011, the State of Georgia did something no other state in the country has done before or since: it wrote into its building code that grid-connected powered attic ventilators are not allowed in new homes. Not discouraged. Not “consult a professional.” Not allowed.12

The exact language, tucked into Section 403.10 of Georgia’s supplement to the 2009 International Energy Conservation Code, reads: “In new construction, power attic ventilators shall not be connected to the electric grid. Power attic ventilators connected to a solar panel are allowed.”

It was, in the polite world of state building codes, a bomb going off. An entire product category — sold by the millions at every Home Depot and Lowe’s in the country — was told, in effect: you don’t belong in our new homes. And 14 years later, not one other state has followed.

That’s the story worth telling. Not just “attic fans are bad” — we’ve been telling that story to our Gulf South clients for years. The bigger question is: why did Georgia break ranks, why hasn’t Louisiana, and what does it mean for the homes being built around us right now?

What Georgia actually did (and what it didn’t)

The PAV amendment didn’t arrive alone. It came as one line item in a much bigger 2011 code package — the one that also made Georgia the first state in the nation to require blower-door testing on every new home, plus mandatory duct-leakage testing and a ban on electric resistance heat as a primary heat source. The Department of Community Affairs Board approved the package on November 3, 2010 after 18 months of task-force work, and it took effect January 1, 2011.34

The PAV line was almost a footnote in the announcement. But it stuck. It survived every code cycle since. The current 2015 IECC with 2020, 2022, and 2023 Georgia amendments still carries it, now with tightened language prohibiting connection to “the Service supply premise wiring system.”5

Three things Georgia did not do, though, are worth being clear about:

ENERGY STAR quietly agrees — in writing

Georgia isn’t operating on a hunch. It’s operating on the same research that led the U.S. EPA’s ENERGY STAR program to make a decision most homeowners never notice: powered attic ventilators are not just uncertified — they are explicitly excluded from certification.

Buried in ENERGY STAR’s Program Requirements for Residential Ventilating Fans, Version 4.2, the specification lists categories of products that are ineligible for the label. Second on that list, right under heat/energy recovery ventilators, is a single line: “Powered attic ventilators (e.g., gable fans).”7

This isn’t an oversight. It’s a written exclusion. And the Department of Energy’s Building America Solution Center — the federal government’s technical clearinghouse for residential building science — puts the two facts side by side in a single sentence: “They are not recommended by the ENERGY STAR program, and they are not allowed by the Georgia State Energy Code (unless solar powered).”8

ENERGY STAR’s consumer-facing attic-ventilation page is only slightly softer, warning that “if your attic has blocked soffit vents and is not well-sealed from the rest of the house, attic fans will suck cool conditioned air up out of the house and into the attic.”9 Which, in the real-world Gulf South housing stock, describes just about every attic we ever crawl into.

Pros and cons: what Georgia’s decision actually did

Was there any public fight over it?

Honestly? Not much. That’s part of why the story is interesting.

There was no PAV manufacturer lawsuit. No home-builder-association floor fight. No governor’s desk showdown. The amendment moved through the State Codes Advisory Committee process, was approved by the DCA Board, and took effect — with the solar carve-out functioning as the release valve for whatever opposition existed. The building-science community (Energy Vanguard, GreenBuildingAdvisor, Building Science Corporation) cheered publicly.12

You can find grumbling on HVAC contractor forums — someone on HVAC-Talk noting dryly that “the solar powered ones did not go over well” — but no organized industry pushback ever materialized. Which suggests the underlying case against PAVs was, and is, stronger than the case for them.

Why Louisiana hasn’t followed — and why it matters

Louisiana operates on a modified version of the 2021 IRC and IECC, and our code says nothing about powered attic ventilators. They’re legal. They’re common. In my personal experience across a lot of New Orleans and Gulf South attics, nearly every contractor from every trade — roofers, HVAC installers, general contractors — either recommends them, installs them, or defends them.

That’s not because our climate is different from Georgia’s. Metro Atlanta and Baton Rouge share Climate Zone 3A most of the way; South Georgia and South Louisiana sit in 2A together. The physics are identical. The housing stock leaks the same way. The gas appliances back-draft the same way.

What’s different is code-office culture and the political will to look at inconvenient research. Georgia was the first state to make blower-door testing mandatory — the PAV ban rode in on the same wave of “actually measure what’s happening in these houses” thinking.13 Louisiana hasn’t made that leap yet.

The takeaway for a Gulf South homeowner

You don’t need to wait for Louisiana’s code to catch up to Georgia’s. The federal government (through ENERGY STAR and DOE’s Building America program), one entire state’s code office, and the building-science research consensus are already in agreement: the powered attic ventilator, grid or solar, is a solution to the wrong problem.

If you already have one, disconnecting it costs nothing. If a contractor is about to install one on your new roof, ask them for the pressure math and the make-up air path before you sign. If they don’t know what those words mean, that’s your answer.

Georgia figured this out in 2011. Fourteen years on, we still have time to catch up — one house at a time, if not one code cycle at a time.
